RF man accused of sexually assaulting handicapped man

A River Falls man is facing up to 40 years in prison if convicted of sexually assaulting a handicapped man.

Michael Radle Myers, 35, posted a $50,000 signature bond April 22 on felony second degree sexual assault/use of force, felony strangulation and suffocation and battery charges. If convicted, he faces up to 40 years in prison (maximum penalty) and/or fines up to $100,000.

According to the complaint:

River Falls police were dispatched at 3:47 p.m. April 21 to 214 S. Third St. for a disturbance. The complainant was a man paralyzed from the waist down who couldn’t flee the apartment where he had been attacked. When officers arrived, they found Meyers passed out on the floor and the caller on the floor partially unclothed. Meyers was highly impaired and couldn’t even formulate sentences. Officers saw a half-empty bottle of Old Crow Whiskey on the table, along with other empty alcohol containers and beer cans strewn about the unkempt residence.

Officers had to lift Meyers up off the floor, help him up the stairs and outside the residence due to his level of intoxication.

The caller told police Myers had recently been fired from his job and was feeling down. He said he ate breakfast with Myers earlier in the day to be a supportive friend. Myers asked the man, who is physically handicapped, to come “hang out” at his apartment and watch movies, to which he agreed.

Myers helped him down the steps into the apartment and the man could tell he was already highly intoxicated when he arrived. The man said he had two drinks while they sat on the couch. He said Myers grabbed his waist, at which point he pushed Myers away. Myers responded by punching him in the eye, pulled him off the couch and sexually assaulted him. The man also had red marks on his neck. When Myers told him to leave, he said he couldn’t without assistance and Myers allegedly hit him multiple times. He blacked out and Myers began choking him. He was able to ask Siri to call 911.

Myers provided a PBT reading of .368; the other man’s BAC registered at .252. EMS transported both men to the hospital. Myers couldn’t stand without falling and fell against a wall in his hospital room. He voluntarily allowed police to take DNA swabs of his cheek and hands.

Myers is scheduled for status conference at 11:15 a.m. May 21.
